August guidance, October reminder
The FTA highlighted its Top-up Tax Scope and Registration guide in a release dated 7 October and a webpage labelled 8 October. The guide itself is dated August 2026; the official guide register lists 26 August. The announcement should not be read as a new October tax regime.
TTGREG1 addresses group scope, entity location and registration under the UAE domestic minimum top-up tax. Its examples cover permanent establishments, joint ventures and flow-through structures.
A registration date worth checking now
Section 8.4 states that entities with a fiscal year ending before 30 April 2026 must apply for registration by 30 November 2026. Other cases follow seven months from the end of the first in-scope fiscal year. The guide cites FTA Decision No. 12 of 2026 for these rules.
Section 8.2 explains why a zero top-up tax outcome does not, by itself, remove registration requirements. The registration analysis must follow entity scope, rather than the expected amount payable.
Group structure drives the work
T&M analysis: an ordinary corporate-tax registration is not evidence that the separate Pillar Two process is complete. Groups should establish which UAE entities are covered, who owns the group information and how their fiscal periods align.
A designated filing arrangement should be checked against the guide's group distinctions. Joint ventures can require separate treatment; simplifying the organisation chart prematurely can produce a misleading registration plan.
