What happened?
Hong Kong gazetted its Inland Revenue (Amendment) (Tax Deductions for Intellectual Property Expenditure) Bill 2026 on 16 October. Introduction in the Legislative Council is scheduled for 28 October.
Key details
It proposes deductions for eligible associate IP acquisitions, certain IP used by overseas licensees and upfront licence fees. Safeguards include a main-purpose test and valuation requirements. Proposed coverage reaches relevant contracts from 1 April 2026, if enacted.
Business impact
T&M analysis: groups considering an IP acquisition or licence should retain agreements, commercial rationale, valuation evidence and the income-flow analysis. Model the proposal as a separate scenario rather than treating the expected deduction as an existing entitlement.
Compare acquisition and licensing structures across the full ownership period, including withholding, transfer pricing and the tax treatment of the resulting income. A deduction at one entity may be outweighed by costs elsewhere in the structure.
What happens next?
Monitor the legislative text and amendments before confirming eligibility, deduction timing or valuation thresholds. The public announcement supports a proposal brief; it does not establish that Parliament has enacted the measure. News and analysis only; not tax, legal or investment advice.
