What happened?

Austria’s National Council approved the Austria–Qatar tax treaty amendment protocol on 14 October 2026, followed by the Federal Council on 22 October. The protocol was signed in Doha on 3 May 2026; the October development is parliamentary approval, not a new signature or confirmed entry into force.

Key details

The replacement dividend article would generally cap source-state tax at 10% of gross dividends where the beneficial owner is resident in the other state. It also provides source exemptions for specified government recipients and a qualifying company, other than a partnership, directly holding at least 10% of capital. A new principal-purpose test addresses entitlement to treaty benefits.

Effective date / timing

Entry into force depends on the later written diplomatic notification confirming completion of domestic procedures. Withholding provisions then apply to amounts paid or credited from 1 January of the following calendar year; other tax provisions apply to fiscal years beginning from that date. Completion of the notification process has not been verified.

Investment impact

Tax & Markets analysis: investors should distinguish portfolio holdings from qualifying direct holdings, document beneficial ownership and residence, and review the commercial rationale for arrangements. Model the protocol as a contingent scenario; parliamentary approval does not justify applying its rates immediately.
