What happened?
The US Treasury announced proposed outbound-investment regulations on 22 October 2026. Published in the Federal Register on 26 October as document 2026-21786, the proposal implements the COINS Act and invites comments by 7 December 2026.
Key details
The proposal would expand covered technology areas to include biotechnology, high-performance computing and supercomputing, and hypersonic systems, alongside changes to existing coverage. Depending on the transaction and applicable conditions, notification requirements or prohibitions would apply to certain investments involving US persons and covered foreign persons.
Effective date / timing
This is a notice of proposed rulemaking, not an effective expansion of the programme. Existing Part 850 requirements continue to govern relevant activities until a final rule becomes effective. The official proposal is available at https://www.federalregister.gov/documents/2026/10/26/2026-21786/outbound-investment-security-program-regulations.
Investment impact
Tax & Markets analysis: Gulf funds should map US-person participation, controlled entities, joint ventures and relevant fund interests before assuming the proposal applies—or does not apply. Investment committees can review technology exposure, diligence questions and contractual information rights now, while keeping proposed obligations separate from current law.
